Enforcing Social Justice: Strict Horizontal Roster Rules for SC(A) Sub-Quota

Following significant structural clarifications by the Madras High Court regarding the nature of affirmative action, the Government of Tamil Nadu has issued fresh executive instructions for implementing internal reservation under the Tamil Nadu Arunthathiyars (Special Reservation) Act, 2009. The fresh mandate applies comprehensively across all government-run, State-aided, and private educational institutions, alongside public employment channels.

The 16% Preferential Sub-Allocation Model

Under the statutory framework of Act 4 of 2009, Arunthathiyars are entitled to a 16% preferential sub-allocation carved directly from the state's total 18% Scheduled Caste (SC) vertical quota. The state has outlined strict sequence protocols to prevent administrative displacement:

  • Merit First Protocol: Institutions must first fill all open-competition, general, and unreserved seats purely on competitive merit. Qualified Arunthathiyar candidates are legally entitled to occupy these general seats without exhausting their sub-quota.

  • The Roster Point System: While processing the 18% SC quota, institutions must strictly implement the 200-point horizontal rotation prescribed via Government Order (G.O. Ms.) No. 50 (April 2009). Under this grid, points 2, 32, and 66 are unconditionally set apart first for SC(A) candidates.

  • Inter-se Merit Safeguards: In remaining SC general seats, all Scheduled Caste sub-groups compete on inter-se merit. Crucially, if an Arunthathiyar candidate secures an SC general seat through high scores, it shall not reduce the protected 16% preferential SC(A) sub-quota under any circumstances.

  • Vacancies Paradigm: If eligible SC(A) candidates are unavailable during a cycle, the vacant preferential seats will be safely unblocked and filled by other non-Arunthathiyar SC candidates based on merit.

For TNPSC and Legal Services aspirants, this directive highlights the technical mechanics of reservation rosters, vertical sub-classification, and state executive authority under Article 15(4) and 16(4).
