The Supreme Court of India has published 'Judgments and Gender: Sensitivity and Compassion in Writing Judgments', which supersedes its 2023 Handbook on Combating Gender Stereotypes. The document advises replacing the word 'prosecutrix' with neutral terms such as victim, survivor or complainant. It urges courts to steer clear of moralising language, victim-blaming and irrelevant questions about a survivor's sexual history. It calls for a trauma-informed approach, respectful handling of witnesses and protection of survivors' dignity and privacy, and promotes the SOGIESC (Sexual Orientation, Gender Identity, Expression and Sex Characteristics) framework for inclusive judicial language.
