Tamil Nadu reconstitutes Preventive Detention Advisory Board under Justice V. Bharathidasan

Save

Through a Government Order of the Home, Prohibition and Excise Department, Tamil Nadu has reconstituted the Advisory Board under the Tamil Nadu Preventive Detention Act, 1982. Retired Madras High Court judge Justice V. Bharathidasan is Chairman, with retired judges P. Kalaiyarasan and V. Parthiban as members. Under Article 22(4) of the Constitution, preventive detention beyond three months needs an Advisory Board, constituted on the recommendation of the High Court Chief Justice, to report sufficient cause. The 44th Amendment of 1978 sought to cut this to two months, but those provisions were never brought into force.
