Supreme Court Recognises Children's Right to Access the Internet under Articles 21 and 19(1)(a)

Save

Ruling that children are entitled to get online and use the internet, the Supreme Court placed this within their fundamental rights under Article 21 (Right to Life and Personal Liberty) and Article 19(1)(a) (Freedom of Speech and Expression). It further observed that blanket prohibitions on internet use could be disproportionate and might push children towards unsafe platforms. Suggested safeguards include parental guidance and supervision, protections suited to a child's age, and separate 'child mode' accounts on social media. Online safety measures, the Court said, should protect children against exploitation while respecting their digital rights, consistent with the Protection of Children from Sexual Offences (POCSO) Act, 2012.
