In Dr. Jaya Thakur vs Government of India, the Supreme Court held that the right to menstrual hygiene forms part of the right to life under Article 21. It noted that lack of sanitary products undermines the right to education under Article 21A and the RTE Act and breaches equality under Article 14. The Court ordered nationwide implementation of the Centre's Menstrual Hygiene Policy for School-going Girls for Classes 6-12, requiring gender-segregated toilets, free sanitary napkins preferably via vending machines, MHM corners and sensitisation of male teachers and students.
