The Supreme Court suspended the UGC (Promotion of Equity in Higher Education Institutions) Regulations, 2026, and, using its Article 142 powers, revived the repealed 2012 regulations in the interim. Petitioners challenged Section 3(1)(c), which defines discrimination only against SC, ST and OBC members, leaving out the general category, and noted the absence of any penalty for false complaints. Examining the rules under Article 15(4), the bench applied the 'principle of no-regression' and questioned why the new rules were narrower than the 2012 version. The rules arose from Abeda Salim Tadvi v. Union of India (2019).
