Supreme Court Directs Centre to Frame No-Fault Compensation Policy for COVID-19 Vaccine Adverse Effects

Save

The Supreme Court of India has asked the Union Government to frame a "no-fault compensation policy" for people who suffered serious adverse effects, or died, after receiving COVID-19 vaccines.

Under no-fault liability, victims or their families can be compensated without having to prove negligence by the government or vaccine makers. The Court held that Article 21 (Right to Life) places a positive obligation on the State to help those hit by rare vaccine complications. Side effects are tracked by AEFI (Adverse Events Following Immunisation) committees. Rare serious reactions include myocarditis, pericarditis and TTS (Thrombosis with Thrombocytopenia Syndrome).
