The Supreme Court has ruled that hanging, as a method of carrying out the death sentence, does not breach Article 21 or the right to dignity. It relied on its 1983 ruling in Deena v. Union of India and noted that Parliament has retained hanging under Section 393(5) of the Bharatiya Nagarik Suraksha Sanhita (BNSS). The Court said constitutional protection continues for death-row prisoners even at execution, and the long-drop method must be done with decency, free of brutality. The Law Commission’s 187th Report (2003) had suggested lethal injection, but such advice does not bind Parliament. The issue may be revisited if fresh scientific evidence emerges.
