Madras High Court: Law Still Permits Candidates to Contest from Two Constituencies

Save
The Madras High Court has observed that the existing law still allows a candidate to contest from two constituencies simultaneously. In 2004, the Election Commission of India had proposed barring candidates from contesting more than one seat, or, if dual candidacy continued, making them bear the cost of a by-election when they vacate one seat. It suggested a deposit of ₹5 lakh for State Assembly polls and ₹10 lakh for Lok Sabha polls for this purpose. These reforms have not become law. In 2023, the Supreme Court upheld Section 33(7) of the Representation of the People Act, 1951, which permits dual candidacy.
