Sub-National Labor Policy: State Government Removes Restrictive Birth Norms to Align with Modern Employment Eligibility Rules

In a major shift regarding civil service eligibility and demographic policy, the Madhya Pradesh Government officially withdrew the 'two-child norm' that restricted eligibility for government jobs and state-level service benefits. The restrictive rule, which previously disqualified individuals with more than two children born on or after January 26, 2001, has been formally struck from proposed civil services regulations.

The 2001 Conduct Rule Repeal and Non-Retrospective Implementation

The administrative policy overhaul seeks to broaden the recruitment pool for aspirants while discarding archaic eligibility barriers:

  • The 2001 Birth Restriction: The defunct rule originated in 2001 under the **Madhya Pradesh Civil Services (Conduct) Rules, 1965**. It rendered candidates with more than two children after the 2001 cutoff date legally ineligible for government service, creating widespread recruitment hurdles for aspirants over the last two decades.
  • Policy Withdrawal Parameters: The State Government formally directed the removal of this restrictive provision from the upcoming civil services draft rules. The withdrawal specifically benefits current government employees and upcoming job aspirants who were previously sidelined by the restriction.
  • Non-Retrospective Scope: Clarifying the legal scope, the government noted that the **withdrawal will not have a retrospective effect**. Consequently, employees who were legally dismissed or disqualified under the previous two-child regime will not be reinstated.
