The Supreme Court observed that States are sidestepping the appointment of regular Directors-General of Police with a fixed two-year tenure and instead installing 'acting' chiefs of their choice. In the 2006 Prakash Singh judgment, the Court used Article 142 to require that DGPs be picked from the three senior-most officers empanelled by UPSC, rejected the idea of acting DGPs, and asked States to send proposals three months before the incumbent retires. The remarks came while hearing Telangana's case, where UPSC said the last regular DGP retired in November 2017 and no proposal had been sent since.
